NE Dairy Farmers Targeting Dean Foods and DFA

Dairy farmers in the Northeast are training their sights on the massive Dairy Farmers of America (DFA) co-op and processing giant Dean Foods in an effort to prove that price fixing and illegal monopolization of the dairy industry has kept milk prices artificially low for struggling producers.

These farmers’ action represents the latest in a series of lawsuits around the country alleging that a lack of competition in the dairy processing industry has resulted in record profits for milk processors at the cost of lower prices for farmers.

Lawyers from Burlington firm Gravel and Shea alongside the Washington, D.C.-based Cohen Milstein firm were slated to make the case for the antitrust class-action suit against four milk processors — DFA, Dean Foods, Dairy Marketing Services (DMS) and HP Hood — in a hearing in U.S. District Court in Burlington on May 6. The defendants are pushing a motion to dismiss the case altogether.

Gov. Doyle Indicates He Will Sign Raw Milk Bill

Wisconsin Gov. Jim Doyle has indicated he will sign a bill the Legislature passed late last month allowing farms to sell raw milk directly to consumers through 2011. Although the bill is limited in scope, advocates who’ve worked for years promoting raw milk say legalization in Wisconsin could lead to broader acceptance nationwide. For the full story, click here.

Final Rule: Producer-Handler Decision

The USDA today issued a final rule amending the producer-handler definition in all Federal milk marketing orders. Producers in all Federal milk marketing orders approved the amendments in referenda held in March 2010.

This rule amends the producer handler definition to limit exemption from pooling and pricing provisions of the orders to those producer-handlers with total route disposition and sales of packaged fluid milk products to other plants of 3 million pounds or less per month. These amendments were considered in a recommended decision published Oct. 21, 2009, and adopted by a final decision published March 4, 2010. The final rule appears in today’s Federal Register. The amendments will be effective June 1, 2010.

Global Dairy Futures Market Being Established in New Zealand

An global dairy futures market aimed at helping companies tackle volatile prices is expected to be launched in the middle of this year in New Zealand. The futures contracts would be on globally traded products, with whole milk powder the first dairy product to be launched, subject to regulatory approval from the New Zealand Securities Commission. The futures contracts would be settled in cash, rather than products, using Fonterra’s online auction globalDairyTrade to determine price. For more detail click here.

DFA Reports Profit Jump

Dairy Farmers of America, Inc., the largest U.S. dairy cooperative, said profit rose 6.3 percent in 2009 as reduced costs and the sale of a business offset slumping milk prices. Net income rose to $65.6 million from $61.7 million in 2008, the Kansas City, Mo.-based cooperative said in a statement today. Sales fell 31 percent to $8.1 billion from $11.7 billion.
